PROMOTION TERMS AND CONDITIONS

These terms and conditions apply to any promotion, competition, contest, event or giveaway featured on any of Highbrook.co.nz, Highbrook Facebook page and Highbrookcrossing Instagram page (“Promotion”).
For the purposes of these terms and conditions, “Goodman” means together or separately as the case may require, Goodman Property Trust or any of its subsidiaries or associated persons.
Any Promotion is in no way endorsed, administered, sponsored or associated with Instagram, Facebook or Meta Platform and any participants in any Promotion hereby release said parties from any liability to the fullest extent possible at law.

1. GENERAL
1.1. These terms and conditions (“PromotionTerms”) govern the Promotion, as described in further detail in Section 2 below.
1.2. Goodman (“Goodman”, “we”, or “us”) is the promoter of the Promotion.
1.3. By entering the Promotion you are accepting that you will be legally bound by these Promotion Terms.

1.5. These terms and conditions incorporate our Privacy Policy and Terms of Use to the extent they do not conflict with the terms set out below.
1.6 All dates and times are in NZ time zone, to be eligible you must have met the required deadlines for entry and acceptance.
1.7 As a participant or winner you consent to Highbrook and Goodman using your image for promotional purposes.

2. PROMOTION MECHANIC
2.1. You can enter the Promotion by following the instructions on our Instagram page, Facebook or website page. The winner will be chosen in accordance with the mechanic described on that medium.
2.2. The Promotion will start and end as described on the post describing the Promotion mechanic.

3. ELIGIBILITY
3.1. You must be aged 18 and over at the date of entry.
3.2. Goodman employees and their immediate families may not enter the Promotion. Any such entries are invalid.
3.3. You must have an active Facebook or Instagram account.
3.4. If the terms of entry require you to comment or tag, it must be a genuine comment or tag.
3.5. You must have followed and met the instructions listed in the post.
3.5. Where an entrant or prize winner has been found to be in breach of any of the terms and conditions of a Promotion and in particular where a person is in breach of the entry restrictions set out in paragraphs 3.1 to 3.3 above, we may still enforce our right to disqualify that person and require the return or reimbursement to us of any prize even where a prize has been awarded and/or actually provided to the entrant or prize winner in question.
3.6. Genuine entrants only
Entrants must enter the Promotion in good faith using a genuine personal Facebook or Instagram account. Accounts created solely for entering competitions, accounts that are fraudulent, misleading, inactive, impersonate another person, use false identities, or otherwise appear to have been established primarily for promotional entry purposes may be deemed ineligible at our sole discretion.
3.7. Multiple accounts and unfair advantage
Entrants may only enter the Promotion using one personal social media account per platform. The use of multiple Facebook, Instagram or other social media accounts by the same individual for the purpose of obtaining an unfair advantage, increasing entry numbers, or manipulating the Promotion is prohibited and may result in disqualification of all related entries.
3.8. Verification of eligibility
We reserve the right to verify the identity, age, location and eligibility of any entrant or prize winner. We may require reasonable proof of identity, residence, account ownership or eligibility before awarding a prize.
3.9. Auckland eligibility
Unless otherwise stated in the Promotion post, entrants must be residents of the Auckland region and be able to collect or receive the prize within Auckland, New Zealand. We reserve the right to request evidence of residence or eligibility before awarding a prize.

4. PRIZE
4.1. The prize/s will be as stated in the Promotion post on the Facebook or Instagram account, further details of which are provided at Schedule 1.
4.2. We reserve the right (when reasonably required to do so) to replace the stated prize/s with prizes that we consider to be of broadly equivalent value. We offer no cash alternative for the prize/s.
4.3. The selected winner may be required to verify their identity, age, eligibility, social media account ownership and, where applicable, Auckland residency before a prize is awarded. Failure to provide requested information within 48 hours may result in forfeiture of the prize and selection of an alternative winner.
4.5. We make no representation or warranty in relation to prize provided and to the fullest extent permitted by law we shall have no liability to you in relation to the prize, or its quality.

5. TERMINATION OF PROMOTION
5.1. If for any reason any Promotion is not capable of running as planned as a result of any (including but not limited to) technical failures, unauthorised intervention, computer virus, mobile network failure, tampering, fraud or any other causes beyond our control which corrupt or affect the administration, security, fairness, integrity or proper conduct of a Promotion, we reserve the right to cancel, terminate, modify or suspend the Promotion and/or to disqualify any individual who (whether directly or indirectly) causes (or has caused) the problem. We will not award the prize if the Promotion is terminated.
Goodman reserves the right, in its sole discretion, to determine whether an entry, entrant or social media account is genuine and complies with both the letter and spirit of these Promotion Terms.
5.2. Fraudulent or unfair conduct
We reserve the right to disqualify any entrant who tampers with, manipulates, abuses or attempts to manipulate the Promotion process, including through the use of multiple accounts, automated entries, bots, fake profiles, fraudulent activity, misleading conduct or any behaviour that compromises the fairness or integrity of the Promotion.
5.3. Right to select an alternative winner
Where an entrant or prize winner is disqualified, fails verification, is found to be in breach of these Promotion Terms, or otherwise becomes ineligible, we reserve the right to withdraw the prize and select an alternative winner.

6. DECISIONS FINAL
6.1. All our decisions relating to the Promotion and/or redemption of the prizes are final. No discussions or correspondence with entrants or any other person will be entered into.
6.2. Tiebreakers, disputes, conflicts, questions or concerns will be managed by us and, if required by law, by an independent adjudicator.

7. FAILURE TO ENFORCE TERMS AND CONDITIONS
7.1. A failure by us to enforce any one of the Promotion in any instance will not give rise to any claim or right of action by any entrant or prize winner, nor shall it be deemed to be a waiver of any of our rights in relation to the same.

8. EXCLUSION OF LIABILITY
8.1. Except as specifically set out herein and to the maximum extent permitted by law, all conditions, warranties and representations expressed or implied by law are hereby excluded.
8.2. To the fullest extent permitted by law, we hereby exclude and shall not have any liability to any entrant or prize winner in connection with or arising out of the Promotion howsoever caused, including for any costs, expenses, forfeited prizes, damages and other liabilities, provided that nothing herein shall operate so as to limit or exclude our liability for personal injury or death caused by our negligence.
8.3. In the event that any provision of these Promotion Terms are held to be illegal, invalid, void or otherwise unenforceable, it shall be severed from the remaining provisions which shall continue in full force and effect.

9. LAWS
9.1. These Promotion Terms shall be construed in accordance with and governed by the laws of New Zealand

10. CONSENT TO BE PHOTOGRAPHED OR FILMED
10.1. By entering an event or program of Highbrook Crossing, you may be entering an area where photography, audio and video recording may occur. Your entry and presence on the event premises constitutes your consent to be photographed, filmed, and/or otherwise recorded and to the release, publication, exhibition, or reproduction of any and all recorded media of your appearance, voice, and name for any purpose whatsoever in perpetuity in connection with the Highbrook or Goodman and its initiatives, including, by way of example only, use on websites, in social media, news and advertising. By entering the event premises, you waive and release any claims you may have related to the use of recorded media of you at the event, including, without limitation, any right to inspect or approve the photo, video or audio recording of you, any claims for invasion of privacy, violation of the right of publicity, defamation, and copyright infringement or for any fees for use of such record media. You understand that all photography, filming and/or recording will be done in reliance on this consent. If you do not agree to the foregoing, please do not enter the event premises.
